Terms of Use

Taiyodani Co., Ltd. (hereinafter referred to as "the Company") establishes these terms and conditions for the use of "HASUA ONLINE STORE" (hereinafter referred to as "the Service") operated by the Company, as follows. Those who use the Service must agree to all provisions of these terms and conditions, so please be sure to read these terms and conditions before registering.

Article 1 Scope and Changes of These Terms and Conditions

  1. These Terms and Conditions shall apply to the use of the Service between the member (as defined in Article 2, Paragraph 1) and the Company, and shall be observed during the registration procedure and after registration.
  2. The Company may add or change new provisions without prior consent of the members by notifying the members through publication on the website, email, or any other method deemed appropriate by the Company.
  3. If these Terms and Conditions are changed, members shall comply only with the changed terms and conditions.

Article 2 Member Registration

"Member" refers to an individual who has agreed to all the contents of these Terms and Conditions, applied for member registration in accordance with the procedures prescribed by the Company, and whose application has been approved by the Company.
The member registration procedure shall be performed by the person who wishes to register as a member, in accordance with the method specified by the Company from the member registration page of the Service. Registration by proxy is not permitted.
The Company may refuse registration or cancel an existing registration without prior notice if the applicant for member registration falls under any of the following items:

  1. If it is found that the applicant has received a disposition such as deletion of member registration due to a violation of the terms and conditions concerning any service provided by the Company.
  2. If the member registration application contains false information.
  3. If there has been a delay in payment or other non-performance of payment obligations for charges related to products or services (hereinafter referred to as "products, etc.").
  4. If the applicant has committed an act prohibited in Article 6 (Prohibited Matters) of these Terms and Conditions.
  5. If the applicant has violated these Terms and Conditions for any other reason.

Article 3 Changes to Registered Information

If any change occurs to all or part of the registered information, the member shall immediately change the registered information by a method separately specified by the Company.
Failure to notify such changes will result in the processing based on the already registered information being deemed proper and valid.
Furthermore, the Company shall not be held responsible for any damages incurred due to the lack of registration changes.

Article 4 Changes to Registered Information

  1. Members shall be solely responsible for the use and management of the user ID and password that they set, approve, and register during member registration.
  2. Members shall not transfer, assign, change the name of, lend, disclose, or leak their user ID and password to a third party.
  3. The Company shall not be responsible for any damages arising from problems with the use and management of a member's user ID and password or credit card number, or from unauthorized use by a third party.

Article 5 Member Withdrawal

  1. If a member wishes to withdraw, the member must delete their member information. Withdrawal will be complete upon completion of the withdrawal procedure prescribed by the Company.

Article 6 Prohibited Matters

When using the Service, members shall not engage in any of the following acts:

  1. Acts that violate these Terms and Conditions and laws and regulations, acts that lead to crime, acts that are contrary to public order and morals, or acts that may lead to them.
  2. Entering false information or third-party information when registering as a member or changing registered information.
  3. Acts that obstruct the operation of the Service or otherwise hinder the Service.
  4. Acts that infringe on the property, privacy, intellectual property rights such as copyrights, or other rights of other members and third parties or the Company, or acts that may lead to them.
  5. Acts of defamation, slander, or damaging the reputation of other members and third parties, or the Company, or acts that may lead to them.
  6. Acts that cause nuisance, disadvantage, or damage to other members and third parties, or the Company, or acts that may lead to them.
  7. Unauthorized use of user ID and password.
  8. Purchases for commercial purposes, such as resales by competitors.

Article 7 Copyright, Trademark Rights, and Other Intellectual Property Rights

  1. All copyrights, trademark rights, and other intellectual property rights of any content (text, illustrations, designs, photographs, images, logos, icons, videos, programs, etc.) (hereinafter referred to as "Content") provided through the Service belong to the Company, and members and users shall not infringe upon these rights.
  2. Regardless of the purpose, it is strictly prohibited to use (duplicate, modify, divert, transfer, distribute, post, sell, publish, etc.) all or part of the Service's content and other posted information without permission.
  3. If a problem arises with a third party in violation of the provisions of this article, the member shall resolve such problem at their own responsibility and expense and shall not cause any damage, loss, or disadvantage to the Company.

Article 8 Purchase of Products

  1. Members can purchase products, etc. from the Company using the Service.
  2. When purchasing products, etc., members shall apply for purchase in accordance with the method specified by the Company.
  3. A sales contract for the products, etc. shall be concluded between the member and the Company when the Company completes the acceptance processing of the application in the preceding paragraph and sends an email to the member notifying them that the products have been shipped.
  4. Notwithstanding the provisions of the preceding paragraph, even after a sales contract for the products, etc. has been concluded, if it is found that the member has engaged in fraudulent or inappropriate conduct regarding the use of the Service, or if there are strong suspicions of such conduct, the Company may, at its discretion, cancel, rescind, or take other appropriate measures regarding said sales contract. The same shall apply if it is found that there was a clear error in the price or other sales conditions of the products, etc. presented by the Company in the Service.
  5. The application for purchase shall be made by the member themselves. Even if a third party acts as an agent for the member or lends the member's name to purchase products, etc., the member shall bear all rights and obligations arising from the purchase of the products, etc.

Article 9 Payment Method

  1. Shipping costs related to the delivery of products, etc. shall be borne by the member. The total payment amount for products, etc. shall be the sum of the product price including consumption tax and shipping costs.
  2. Payment for products purchased through the Service shall be made by credit card in the member's name, Shop Pay, Apple Pay, Google Pay, AmazonPay, PayPal, convenience store payment, Paypay / LINEPay / Merpay / auPAY / Rakuten Pay, bank transfer, Pay-Easy, or Paidy [post-payment].
  3. Credit card payments shall be subject to the terms and conditions separately agreed upon by the member and the credit card company. In the event of a dispute between the member and the credit card company or other third parties, the parties involved shall resolve the dispute, and the Company shall not bear any responsibility.

Article 10 Returns and Exchanges of Products

  1. Returns and exchanges of products will only be accepted if the Company is contacted at the "Contact for Returns and Exchanges" listed in the "User Guide" within 7 days of product arrival, in accordance with the Company's separately stipulated provisions.
  2. Members shall return products in accordance with the procedures separately stipulated by the Company.
  3. Shipping costs for returns and exchanges shall be borne by the Company only in cases attributable to the Company, such as defective products or incorrect delivery. Returns and exchanges due to member's convenience (such as incorrect size or difference in image) other than the preceding paragraph will not be accepted.
  4. For members requesting an exchange, the product will be shipped as soon as it arrives at the Company and the corresponding product is available.
  5. If an exchange is not possible due to out of stock, etc., a refund will be issued. The refund method will be carried out in accordance with separately stipulated provisions.

Article 11 Disclaimer Regarding Products, etc.

  1. Warranties for products, etc. sold through the Service shall comply with the contents of the attached product warranty, unless otherwise explicitly stated.

  3. Due to screen settings and photographic techniques, colors and sizes may differ slightly from the actual product.
  4. The Company shall not bear any warranty or responsibility, other than that stipulated in Paragraph 1 of this Article, regarding the quality, performance, compatibility with other products, other defects of products, etc. sold through the Service, and any damages, losses, or disadvantages caused by them.
  5. The Company shall not be responsible for any troubles, including unknown delivery addresses, that occur after the Company has delivered the product to the contracted delivery company and requested shipment of the product to the delivery address registered by the member.

Article 12 Information Management

The Company shall use the acquired member information for the following purposes. Furthermore, the Company may outsource this to a business contractor selected by the Company to achieve these purposes.

  a. Management of Service members and users  b. Issuance of e-mail newsletters  c. Provision of point services, etc.  d. Introduction, advertisement, promotion, and solicitation of sales of Company products, etc.  e. Shipping of products  f. Customer support  g. Planning and implementation of campaigns and surveys  h. Provision of other content related to the Service  i. Marketing activities after processing to a state where individuals cannot be identified

As a general rule, the Company will not disclose or provide member information disclosed by members during member registration procedures and subsequent changes to member information to third parties without the prior consent of the member. However, in the following cases, the Company may disclose or provide such member information without the prior consent of the member:

  a. When processed into statistical data in a state where individuals cannot be identified.
  b. When requested to disclose or provide member information based on laws and regulations.

The Company may delete or change the posting location of comments and other information transmitted by members with the Company's permission, without notifying the member, if the Company deems it necessary, for reasons such as when such information clearly damages the reputation or credibility of other members, third parties, or the Company, or violates laws and regulations.
In addition to the preceding three paragraphs, the Company shall handle acquired member information in accordance with the separately stipulated "Handling of Personal Information."

Article 13 Use of Service

To use the Service, you must agree in advance to these Terms and Conditions and the "Handling of Personal Information" separately stipulated by the Company.

Article 14 Changes/Abolition of Service

  1. When emergency maintenance and inspection are required due to troubles in the computer system (hereinafter referred to as "the System") that provides the Service.
  2. When operation of the System becomes difficult due to fire, power outage, natural disaster, or other force majeure.
  3. When operation of the System becomes difficult due to man-made disasters (war, riots, civil unrest, labor disputes, etc.).
  4. When operation of the System becomes difficult due to interference by a third party, etc.
  5. Other unavoidable circumstances
  6. When the Company determines that the System needs to be stopped.

Article 15 Other Disclaimers

  1. The Company shall be exempt from any damages incurred by members as a result of the Company processing operations in accordance with the member's registered information.
  2. The Company shall not be held responsible for any damages caused to members due to disruptions, delays, or interruptions of the system, or alteration of web pages, even if the Company has taken reasonable safety measures, and despite the occurrence of failures in communication lines or computers.
  3. The Company does not guarantee that emails and content sent from the Company's web pages, servers, or domains do not contain harmful elements such as computer viruses.
  4. The Company may provide information and advice to members from time to time, but this does not imply responsibility.
  5. The Company shall not be responsible for any damages incurred due to a member's violation of these Terms and Conditions.

Article 16 Governing Law and Agreed Jurisdiction

These Terms and Conditions shall be interpreted in accordance with Japanese law, and in the event that litigation becomes necessary concerning these Terms and Conditions, the Tokyo District Court shall be the agreed exclusive jurisdiction of the first instance.
